PMR’s Los Cabos Vacation Giveaway 2009 (the “Giveaway”) is sponsored by Pacific Monarch Resorts (“PMR”) and its affiliated companies (collectively, “Sponsor”). PMR is located at 23091 Mill Creek Drive, Laguna Hills, CA, 92653. The Giveaway begins on October 1, 2008 at 12:01 a.m. Pacific Standard Time (“P.S.T.”) and ends on June 30, 2009 at 11:59 p.m. P.S.T. (“Giveaway Period”). The odds of winning depend on the total number of entries received. Limit one entry per household. Other restrictions apply. By participating, entrants agree to these Official Rules. PRIZE: One grand prize (the “Grand Prize”) will be awarded to one winner who will be given a choice of either: (A) trip for two to the Sponsor’s resort located in San Jose del Cabo, Mexico, the Cabo Azul Resort & Spa including (1) seven consecutive nights in a one-bedroom garden view suite with an approximate retail value of $6,200 which includes Mexico hotel tax; (2) round-trip, coach class airfare for two (up to $750 per person with travel arranged by Sponsor) departing from a major U.S. commercial airport located selected in the Grand Prize winner’s reasonable discretion; and 3) $1,000 in spending money, made payable to the winner by certified check in one lump sum; or (B) $5,000 made payable to the winner by certified check in one lump sum. Winner is solely responsible for all expenses/charges not specified above, including, without limitation: Transportation to and from departing airports; ground transportation in and around destination location; meals, beverages, taxes, gratuities, and fees; souvenirs; hotel services, and incidentals. Travel dates are subject to availability as may be impacted by holiday or seasonal demand. Winner and traveling companion(s) are responsible for obtaining all required travel documents such passports and visas. State, federal and local taxes, including income taxes, are the sole responsibility of winner. Sponsor will furnish to the IRS any required tax reporting forms relating to the award of Grand Prize. Winner must provide Sponsor with any information required for such IRS reporting. Winner will receive an IRS Form 1099 for the retail value of the Grand Prize. Winner and traveling companion(s) must travel on the same itinerary. Travel dates and times are subject to availability at time of booking travel. Travel must be completed by June 30, 2010. All travel must be arranged through Sponsor. The approximate retail value of the Grand Prize is $8,700, depending on the point of origin and the time period in which the Grand Prize trip is taken. If the value for the Grand Prize trip does is less than $8,700, winner will not be entitled to any compensation or reimbursement for the difference in value. DRAWING: One (1) Grand Prize winner will be selected on or about July 15, 2009 by a random drawing conducted by Sponsor from among all eligible entries received. ELIGIBILITY: As of the date of entry, participants must be legal residents of the United States (residents of Puerto Rico, Guam and any states where otherwise prohibited by law, rule or regulation are not eligible for this Giveaway), and at least 18 years old. Officers, directors, employees and shareholders of Sponsor and the immediate families thereof, are not eligible to participate in this Giveaway. “Immediate family” means only spouses, parents, and children. The Giveaway is subject to all applicable federal, state, local laws and regulations, and is void where prohibited or restricted by law. Entries must be received by Sponsor no later than June 30, 2009 at 11:59 p.m. P.S.T. Sponsor and its subsidiaries, affiliates, consultants, agencies and employees are not responsible for incorrect, inaccurate or incomplete entry information; lost, stolen, late, postage due or misdirected entries; destruction or alteration of entries; unauthorized access to entries; human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any web site or online service, or any other error or malfunction, or any entries that for any reason are not received by Sponsor by June 30, 2009 at 11:59 p.m. P.S.T. Proof of sending an entry will not be deemed to be proof of receipt by Sponsor. The following required fields must be completed for entry forms to be valid: (1) full legal name; (2) complete home address; (3) phone number; (4) valid email address. Giveaway entries generated by a script, macro or other mechanical or automated means will be disqualified. Incomplete entries are void. All information submitted by entrants is subject to Sponsor’s Privacy Policy accessible at: http://www.caboazulresort.com/cabogiveaway . SELECTION OF WINNER: Subject to the eligibility requirements in these Official Rules, the participant whose entry is randomly selected on or about July 15, 2009 will win the Grand Prize. Sponsor will notify the winner by certified mail, return receipt requested, addressed to the home address provided on winner’s entry form. Before receiving the Grand Prize and as a condition of receiving such Grand Prize, the winner will be required to provide valid photo identification featuring winner’s name and address as it appeared on the entry form, as well as social security number, date of birth, proof of residency, and valid state identification. Winner must sign an Affidavit of Eligibility & Release supplied by Sponsor, which, among other things, releases Sponsor and its subsidiaries, directors, agents, agencies, affiliates, advertisers, promoters, officers, directors, employees and related persons from any and all liability related to this Giveaway and Grand Prize. Winner must return these documents no later than 14 days after receipt. Winner may be required to sign other legal documents (including tax forms) or show additional proof of eligibility. If winner fails to sign and return the documents within 14 days of receipt, or fails to meet any eligibility requirement, an alternate winner will be chosen by random drawing, to be held as soon as reasonably practicable. Alternate winner is subject to all eligibility requirements and restrictions of these Official Rules. OTHER RESTRICTIONS: The Grand Prize may not be extended, transferred, or substituted except that Sponsor may substitute a Grand Prize of equal or greater value if Sponsor deems it necessary. Traveling companion(s) of winner must be at least 18 years of age or accompanied by a parent or legal guardian who must also execute an affidavit of eligibility and release. Sponsor is solely responsible for awarding Grand Prize. Sponsor will not replace any lost or stolen tickets, travel vouchers, or certificates. MISCELLANEOUS: Sponsor reserves the right to cancel, terminate or suspend part or all of this Giveaway at its sole discretion should any virus, non-authorized intervention, telecommunications or computer failure, malfunction, or other cause beyond their reasonable control corrupt or impair the security, administration, fairness and/or operation of this Giveaway. In such event, a drawing will be conducted to award the Prize using all entries received as of the time of cancellation, termination, modification or suspension. Sponsor reserves the right to correct typographical, clerical or printing errors in any Giveaway materials. Sponsor and its subsidiaries, affiliates, consultants, agents and employees will not be liable for any injury, loss, damage or liability of any kind (including, without limitation, damage to computer equipment) resulting from participation in this Giveaway, downloading, or the acceptance or use of any prize or travel related to the acceptance or use of any prize. Any person suspected of defrauding or tampering with this Giveaway in any way will be disqualified and may be prosecuted to the full extent of the law. Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Giveaway, and to resolve all disputes in its sole discretion. Sponsor makes no warranty, guaranty or representation of any kind concerning any prize, and disclaims any implied warranty.
